The Small Print

Welcome to MONKEY CHAR LOOSE LEAF TEA, the online tea place where you can buy ethically sourced, organic loose leaf teas, herbal infusions, tea accessories and original art work.  We’d much rather be off creating new tea blends but apparently we’ve got to put all the legal stuff down in writing.

So here it is – “The Small Print”.  Take a deep breath, grab a pot of your favourite tea and take a few moments to read these terms and conditions (T&Cs) as well as our privacy policy. (Our T&Cs apply if you are placing an order via the internet or by phone). We reserve the right to vary these T&Cs at any time, but in respect of any ordered goods, the T&Cs which apply shall be those which you accept at the time of placing your order.

MONKEY CHAR is the trading name of MONKEY CHAR LOOSE LEAF TEA.  You can contact us via email on [email protected] or write to us at: 46 Highclere Road, Guildford, Surrey, GU21 2PJ

We may from time to time make changes to these Terms and Conditions, so please review them regularly to ensure you are aware of any changes made by us. If you place orders for Products after changes are posted and you are notified in this way this will indicate that you agree to be legally bound by the Terms and Conditions as updated and/or amended. In the event you do not agree to any revised Terms and Conditions, you should not place further orders for Products. By accessing or using this website, you are agreeing to be bound by the Terms & Conditions of this website. Your continued access of this website shall be deemed your conclusive acceptance of these terms & conditions.

The purchase of goods is limited to parties that lawfully can enter into and form contracts on this site under English law. To purchase, you must provide your real name, phone number, e-mail address, and postal address, or have an account with PAYPAL. This site is available only to individuals and others who meet the terms of eligibility, who have been issued a valid credit card or cheque by a bank acceptable to PAYPAL, whose applications are acceptable to PAYPAL and who have authorised MONKEY CHAR via PAYPAL to process a charge or charges in the amount of the total purchase price for the goods which they purchase.

All orders are subject to acceptance by us. After you place an order, we will acknowledge receipt of your order by sending you an order acknowledgement email. This acknowledgement email will not constitute our acceptance of your order. Your order will only be accepted by us when we send you a shipping confirmation email when we have dispatched your order. MONKEY CHAR will use its reasonable endeavours to keep copies of all contracts for orders placed for Products by you, but cannot guarantee that it will keep a copy of every agreement for an unlimited time due to the number of orders for Products that it receives. You should therefore print out a copy of these Terms and Conditions and the shipping confirmation email in relation to all purchases and keep them in a safe place as a record of each transaction. Contracts with MONKEY CHAR are concluded in English.

The prices for any Products ordered will be as quoted on our web site from time to time, except in the case of obvious errors. All prices are inclusive of VAT and the cost of delivery will be separately itemised at the PAYPAL Checkout.  PLEASE NOTE: Only UK Standard Delivery is calculated on this website, if you would like an express or signed for delivery please contact us to let us know before placing your order.

Goods are subject to availability.  Our acceptance of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase, we will let you know as quickly as possible and a full refund will be given. Orders that include sale items may be sent incomplete if certain sale lines are out of stock. Your card will be refunded and you will be notified as above.

PLEASE NOTE: Only UK Standard Delivery is calculated on this website, if you would like an express or signed for delivery please contact us to let us know before placing your order.

For all European and overseas orders please email us to place your order.  Details on approximate shipping costs can be found on our Delivery Costs page. When ordering goods from outside the UK, you are responsible for ensuring compliance with the laws of the importing country and for paying all applicable customs duties, taxes and import charges.

Whilst we do our utmost to ensure your order is dispatched and delivered as promptly as possible, on rare occasions, orders can take longer than the suggested time frame. Where possible, should we be unable to dispatch an item within the designated time frame, we shall contact the buyer via email used to place the order. Once an item has been dispatched, as advised by the designated courier, in rare cases, items sent can take up to 15 working days to be delivered.

You may cancel your order at any time and for any reason within 7 working days of delivery of the Products ordered. ('working' days do not include Saturdays, Sundays and UK public holidays). Orders for certain Products may not be cancelled - these include: (a) Products that have been clearly personalised; and (b) Products that are perishable and have been opened, including all teas, infusions and food products. If you wish to cancel your order you must notify us of your wish to cancel in writing and you must return the Product(s) to us (at your expense) in their original wrapping, intact and accompanied by all accessories and documentation which were part of the delivery. We will refund any monies paid to us in respect of a cancelled order within 30 days of receiving your notice of cancellation and having received the returned goods in re-saleable condition.

Where these Terms and Conditions require you to notify us of certain things in writing, notices should be sent to us by post to our address above or by e-mail to [email protected]. If we need to notify you of anything, we will do so by e-mail or the postal address you provide during the order process. Cancellation or Damage:

If you receive a Product which is faulty or damaged please notify us immediately by one of the methods specified in the Contact Details section and return the relevant Product to us together with a brief explanation of the fault or damage. We may, as we think appropriate, either credit you with an appropriate sum in respect of the Product or we shall (subject to availability) send you a replacement Product. This does not affect your statutory rights.
